FMV Assessor is a personal productivity tool that helps users track charitable donations, estimate fair market values using AI, and generate records for personal tax reference. The Service is provided for informational and organizational purposes only.
3. Not Tax or Legal Advice
IMPORTANT: FMV Assessor is not a licensed tax advisor, CPA, or legal professional. All fair market value estimates generated by the Service are provided for informational purposes only and do not constitute professional tax, legal, or financial advice.
AI-generated valuations are estimates based on general market data and may not reflect actual IRS-accepted values for your specific items. You are solely responsible for verifying valuations, maintaining appropriate records, and consulting a qualified tax professional before claiming charitable deductions. Refer to IRS Publication 561 ("Determining the Value of Donated Property") for official guidance.
4. User Accounts
You must sign in using a valid Google or GitHub account. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to submit fraudulent tax claims
- Upload content that is illegal, harmful, or infringes third-party rights
- Attempt to reverse-engineer, scrape, or abuse the Service
- Share your account with others or resell access to the Service
- Interfere with the operation or security of the Service
6. Your Content
You retain ownership of the photos and data you submit. By uploading content, you grant us a limited license to store and process it solely for the purpose of providing the Service to you. We do not claim ownership of your content and will not use it for any other purpose without your consent.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that AI valuations will be accurate or accepted by the IRS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FMV ASSESSOR AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO TAX PENALTIES, AUDIT COSTS, OR RELIANCE ON AI-GENERATED VALUATIONS.
9. Service Availability
We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
10. Changes to Terms
We may update these Terms of Service at any time. We will update the effective date at the top of this page when changes are made. Continued use of the Service after changes constitutes your acceptance of the revised terms.
